A peculiar legal dispute between Random House and the estate of Göbbels could undo several centuries of good law.
Random House claims explicitly and openly that
because we don't like Göbbels we don't need to pay his descendants for copyright.
This notion was part of Common Law at one time, but was removed by the Constitution's prohibition on
Bills of Attainder.
You can't punish a descendant for acts of his ancestor.
Modern Gramscian fascists have been pushing back toward the older idea of Corruption Of Blood, in issues like reparations for slavery. So far this atavism hasn't invaded copyright or business law. If Random House gets what it wants, Bills Of Attainder will return. Descendants of currently unfashionable people will be officially Untouchables, unprotected by laws.
