Mainstream
The Senate is going through its usual pointless parade of artificial simulated debate-like substance before automatically approving Comrade Kagan for the Supremes.
The main Brand-D talking point this morning says Comrade Kagan is "in the mainstream of American legal thought."
Unfortunately this is perfectly accurate, though the
desired impression of the phrase is wildly false.
The "mainstream" of legal thought is now hard-line radical lesbian, hard-line Mussolini Subjectivist, violently opposed to every word, letter, comma, period and semicolon of the written Constitution. Kagan is comfortably centered in this bloody Maoist/Fascist river, bobbing cheerfully along in this Red Tide.

Another Supreme-related story: today's decision that the 2nd Amendment applies to everyone. This shouldn't have needed a court decision, because the Amendment is perfectly clear as written. The 1st Amendment begins with "Congress shall make no law", thus it applies solely to the Federal gov't. The 2nd Amendment says "the right to bear arms ... shall not be abridged", thus it applies to all layers of gov't. That's easy, and doesn't require any fancy footwork about the 14th Amendment supposedly extending only some guarantees to the states. There is nothing in the 14th about modifying other amendments, hence it does not modify other amendments. See how simple it is when you KNOW HOW TO READ?
But the reaction to this decision is more interesting. Cities with gun bans are gearing up for new ways to
circumvent the court and keep their gun bans. Mayors are
saying that they need to continue the ban in order to protect their citizens from gun violence. And here's the problem. Chicago and DC have bureaus of crime statistics, so their mayors know goddamn well that Chicago and DC are at the top of the murder list, with the
least protected citizens in the US. Therefore they know goddamn well that their gun bans cause maximal gunfire by criminals, no matter how loudly they proclaim the idiotic opposite. Thus we can conclude, by
Polistra's Law of Inferred Intent, that the rhetoric about "protecting citizens" is transparently false, and that the mayors of Chicago and DC are simply gangsters who want their gangster associates to maintain their monopoly on violence. Inescapable logic.
